We regularly advise employers on preventative measures that should be taken to protect businesses from the risk of vicarious liability, being where the company is liable for the wrongdoing of a member of their staff.
Such measures would be management training and preparation of relevant policies for a staff handbook such as an anti-harassment and bullying policy and equal opportunities policy. We regularly advise employers who face claims of discrimination raised by employees.
We also advise employers and employees in respect of prohibited conduct (direct & indirect discrimination, harassment, victimisation, discrimination arising from a disability or pregnancy, maternity discrimination or breach of the duty to make reasonable adjustments) as a result of a protected characteristic (age, sex, disability, gender reassignment, marriage/civil partnership, pregnancy and maternity, race, religion or belief). This may be on steps to take to address such issues whilst still in employment or following a resignation and the steps to pursue or defend a claim for discrimination in the Employment Tribunal. If a dispute cannot be resolved we often take steps to conclude the employment relationship using a settlement agreement and advise the employer or employee on this agreement.
