Cookie Update - New ICO Guidance Issued

Following on from our recent article ("Have you got a cookie monster lurking in the wings?"), the Information Commissioner`s Office has just released its initial Guidance on the operation of the new law relating to website cookies. In short, if the operator of a website wishes to place a cookie on a user`s computer it must first obtain that user`s consent. It is not yet clear how this can be achieved without subjecting the user to a potentially cumbersome tick-box process, although it is hoped that industry-led solutions will emerge over the coming weeks and months. 

In the meantime the ICO has advised that each organisation with a website should:

1. check what type of cookies and similar technologies it uses and how it uses them;

2. assess how intrusive that use of cookies is; and

3. decide what solutions to obtain consent will be best in the circumstances.
