We advise employers in respect of the steps to take to manage employees who have a record of intermittent absence or are absent on a period of long term sickness absence. Such procedure can be affected in circumstances where the employee may be considered a disabled person within the meaning of the Equality Act 2010 and there may, for example, be a need to request a GP or Occupational Health report.
Absence Management should be dealt with appropriately and regular contact should be maintained with the employee where the ultimate conclusion can be dismissal for ill health capability in order to show that the employer has acted fairly and within the range of reasonable responses.
