If you are wondering how to get divorced, we can provide advice on the best way to handle this. You will need to consider other issues alongside the actual divorce, such as a financial settlement and arrangements for any children you have.

Separation agreements
If you are not yet ready to finalise a divorce, then a separation agreement can be a useful roadmap, setting out how a range of issues will be dealt with between you. This could include:
- Who will live in your home
- Who will pay outgoings, including mortgage payments and utility bills
- Whether one of you will buy out the other’s share in your property
- How other assets will be split
- How debts will be dealt with
- Whether maintenance will be paid
- Arrangements for children
Negotiating a separation agreement can reduce conflict and give you both a level of certainty until you are ready to go ahead with a divorce.
Getting a divorce
If you have been married for a year or more and you believe that your relationship has irretrievably broken down, you can apply to the courts for a divorce.
Before applying, it is strongly recommended that you speak to expert divorce solicitors. You will usually be advised to deal with financial matters before your divorce is finalised.
To obtain a divorce, you will need to start by filling in an online application form. You can apply on your own or jointly with your spouse. We can complete the form on your behalf and help you through the application process.
As well as filling in the form, we will need to provide the courts with a certified copy of your marriage certificate. When the form is submitted, a court fee has to be paid.
The court will send a copy of your divorce application to your spouse or their legal representative. Once the application has been issued, you will need to wait for 20 weeks before you can take any further action. This is a cooling off period.
Once the 20 weeks has passed, we will apply for a conditional order. Once this has been issued by the court and served on your spouse, we will be able to apply for a final order after a further six weeks.
It is often advisable to wait until financial matters have been dealt with before finalising a divorce.
Financial matters
When you divorce, it is strongly advised to put a financial order in place. Without this, there is a risk that your former spouse could make a claim against you at any point in the future.

- How assets will be shared, including pensions, investments, business interests and valuable items
- Who will take responsibility for debts

If an agreement is reached with your former spouse , this can be drawn up into a financial consent order and sent to the court. Once the order is approved by the court it becomes legal binding.
Arrangements for children
You can also consider putting arrangements for children in place if you are going through a divorce.
The courts prefer that couples make child arrangements between themselves wherever possible and we can negotiate on your behalf to try and reach an agreement. We are often able to find the right solution without the need for litigation, which is generally a faster and more cost-effective way of handling matters.
A child arrangements order is a court order setting out details of where your child will live, how much time they will spend with their other parent, how they will stay in touch with you both when you are not with them and other issues such as schooling and holiday arrangements.
